This policy explains how we, Fooodpanda Taiwan Co. Ltd. (hereinafter referred to as “foodpanda”),and our parent company, the Delivery Hero SE Group (hereinafter collectively referred to as the “Group”) use the personal information, including but not limited to our website and mobile applications (jointly referred as “Website”).
Please read this Privacy Policy carefully and make sure you fully understand it before using our services. By visiting and/or ordering services provided on this Website, you agree and, where required, consent to the Group’s collection, use and processing of your information as set out in this policy.
2. What information do we collect about you?(For consumers)
We collect personal information from you when you order food, goods or services from us or use our Website. We also collect information when you complete any consumer survey. Website usage information may also be collected using cookies (as defined below).
foodpanda will collect information that personally identifies you and/or your location, where required (this may include your name, birthdate, email address, home address, telephone number, geolocation and social links etc.), but only when you voluntarily give it to us. You may be required to provide us with your credit card and invoicing information, such as your credit card number, cardholder name, credit card expiration date, credit card verification code (CVC), and Citizen Digital Certificate, depending on the payment and invoicing method you choose. We collect this information exclusively to carry out the functions offered on the Website and to provide you with offers and information about foodpanda and other services we think you may be interested in. We might collect this personal information through: online food ordering; entry into competitions; subscribing to our newsletter; creating a user account; sending 'contact us' messages or other correspondence through the Website; or through advertising, research and direct marketing.
What personal data does foodpanda require? (For vendors)foodpanda collects the personal data you provide during the partnership process, including basic contact information (such as name, job title, contact number, email address, mailing address), business registration information (such as business registration number, company name, and business address), as well as payment and tax information (such as payee details, bank account information, and details required for issuing electronic invoices). If you are a corporate vendor and not a domestic or foreign government agency or a publicly listed company, in accordance with the relevant provisions of the Taiwan Anti-Money Laundering Act, foodpanda will also collect the personal data of the beneficial owner(s), including their name, nationality, date of birth, and identification document number, in order to carry out the necessary consumer due diligence and compliance procedures. The above data may be obtained through the partnership registration process, contract signing, platform systems, consumer service communications, or any other means by which you voluntarily provide the information. It will be used for specific purposes such as establishing the partnership, fulfilling contractual obligations, processing payments and tax matters, risk management, anti-money laundering and consumer identification procedures, providing support services, and partnership notifications.
We do not collect sensitive information about you.
3. Cookies
Some of the information collected will not personally identify you but will instead track your use of the Website so that we can better understand how the Website is used by consumers and in turn enhance and improve your experience in ordering food. We may obtain this information by use of cookies. Cookies are a small data file transferred to your device that recognizes and identifies your device and allows your device to 'remember' information from the Website for future use. Cookies do not contain any information that personally identifies you and we do not use cookies in order to obtain such information - your personal information can only be obtained by foodpanda if you actively provide it to us. We may collect technical information from your mobile device or your use of our services through a mobile device, for example, location data and certain characteristics of, and performance data about your device, carrier/operating system including device and connection type, IP address, mobile payment methods, interaction with other retail technology such as use of NFC Tags, QR Codes or use of mobile vouchers. 4. Social Media
A. If you have a Facebook profile, you can register for a consumers account on our website or app using the social plugin "Facebook Connect" of the social network Facebook, which is operated by Meta Platforms, Inc., using Single Sign-on technology. You can recognize the social plugins of "Facebook Connect" on our website or app by the blue button with the Facebook logo and the inscription “Continue with Facebook”.
By using this “Facebook Connect” button on our website or app, you can also log in or register on our website or app using your Facebook user data. Only if you give your express consent prior to the registration process on the basis of a corresponding note on the exchange of data with Facebook, will we receive the general and publicly accessible information stored in your profile when using the Facebook "Facebook Connect" button on Facebook, depending on your personal data protection settings on Facebook. We will never receive your Google password and cannot log in to your Google account. The data transmitted by Google is stored and processed by us solely for the creation of a user account with the necessary data.
C. If you have an account with Apple, you can use this account to log in to our service.
By using the “Continue with Apple” button on our website or app, you can log in or register on our website or app using your Apple user data. Only if you give your express consent prior to the registration process on the basis of a corresponding note on the exchange of data with Apple, will we receive your Apple user ID, user name and email address. We will never receive your Apple password and cannot log in to your Apple account. 5. Storage and security of your personal information
foodpanda will use all reasonable endeavors to maintain the security of your personal information and to protect your personal information from misuse, interference and loss and against unauthorized access, modification or disclosure. foodpanda will destroy any personal information it holds about you which it no longer requires under the terms of this Privacy Policy.
Where you have chosen a password to access certain services of the Website, you are responsible for keeping your password confidential. We recommend not sharing your password with anyone.
Due to the nature of the internet, foodpanda does not provide any guarantee or warranty regarding the security of your personal information during transmission to us or storage by us and you acknowledge that you disclose your personal information to us at your own risk. Please contact us immediately if you become aware or have reason to believe there has been any unauthorized use of your personal information in connection with the Website.
Your personal information will be disclosed in the profile area (if you have provided it), including name, e-mail, date of birth, mobile phone number, and linked account, so that you can confirm the information entered through the interface is correct. When using the APP, please pay attention to information security and avoid others from peeking.
6. Fraud detection, Prevention, and Operational security
To protect your safety when using our Website and to prevent unauthorized access, fraudulent activities, and other malicious attacks, foodpanda continuously monitor the usage of our Website and mobile applications. foodpanda employ various information security technologies and risk management tools to ensure you have a secure ordering experience. foodpanda has implemented multiple security protection mechanisms to prevent account takeovers, abnormal transactions, and other potential misuse. To effectively detect and prevent fraudulent activities, we process and analyze your location data, basic personal information (account details), device information and access logs, payment data, and records of orders and coupon usage.
Such data may be processed through algorithms and machine learning models for automated decision-making to help identify suspicious behaviors and abnormal transaction activities. If the system automatically detects potential fraud or risks, we may temporarily restrict or terminate your access to certain services and may require you to complete additional verification procedures. If you have any concerns regarding the results of automated decision-making, you can contact us through the “Consumer Service Center.”
7. How will we use the information we collect from you?
You consent to the Group collecting, processing and using your personal information for processing and delivering the order/s placed on the Website and any other service provided through the Website. In particular you expressly consent that the Group may disclose your personal information, including your name, email address, physical address and phone number to riders delivering your order, either employed by the Group or by third parties providing delivery services to he Group.
foodpanda may disclose your personal information, and you consent to the disclosure of your personal information, to:
- other entities within the Delivery Hero SE group of companies; and
- third parties engaged by Delivery Hero SE or other members of the Delivery Hero SE group to perform functions or provide products and services on our behalf such as processing payments, mail outs, debt collection, research, statistical information, marketing activities;and
- outsourced service providers, other business partners of foodpanda (for example, international credit card organizations, electronic payment and acquiring institutions, and companies such as Google, Facebook, LINE, Apple, etc.), recipients of international personal data transfers not restricted by the competent central authority, and any parties consented to by our consumers (for example, companies conducting joint marketing or cross-use of consumer data with foodpanda, or companies collaborating with us on promotional activities).
Please note that if you withdraw your consent to the use of your personal information by third parties, the Group may no longer be able to provide you with the relevant services/p>
the Group reserves the right to disclose your personal information if it is required or authorized to do so by law, or, if it is reasonably necessary in its opinion to protect the rights or property of the Group or any third party, or to avoid injury to any person.
If foodpanda undergoes a transfer, merger, or reorganization, some or all of your personal information may be provided to the relevanta third partiesy.
You consent to the Group using your personal information for advertising, direct or indirect advertising or marketing purposes in order to inform you about the Website and the goods and services it provides, or other matters that it believes will be of interest to you.
If you would like to unsubscribe from receiving newsletters and marketing communications from the Group, please follow the steps to unsubscribe, we will remove your email address from our mailing list within a reasonable period of receipt of your request.

(1) Open one of foodpanda’s newsletters.
(2) Scroll to the bottom and click on "Unsubscribe Newsletter."
Please note that once you unsubscribe, you won't be able to resubscribe.
8. International data transfers
In providing our services, foodpanda may transfer your personal data to foodpanda group locations outside of Taiwan (including Germany and Singapore) for storage or processing. The personal data protection laws of these countries may differ from those in Taiwan; however, your personal data will remain protected under the applicable foreign laws. When we transfer your personal data to other countries, we will protect it in accordance with this Privacy Policy and comply with all applicable legal requirements, such as entering into data transfer agreements or implementing other appropriate data transfer mechanisms.
9. Access to your information
foodpanda will use all reasonable endeavors to keep personal information it holds accurate, complete, up-to-date, relevant and not misleading. Please contact us if you would like to access the personal information foodpanda holds about you. We will use reasonable endeavors to provide a complete list of your personal information within a reasonable period of receipt of your request. Please contact us by clicking on the "Menu" button in the upper left corner and selecting "Help center". foodpanda reserves the right to charge a nominal fee for the processing of this request in accordance with local legislation.
You may contact us to correct any of your personal information that is inaccurate, incomplete or out-of-date, or to request that your personal information be deleted. We will use reasonable endeavors to correct or delete your personal information as requested within a reasonable period of receipt of your request.
Deletion of your account with foodpanda will not automatically delete the personal information held about you. If you would like foodpanda to delete all personal information together with the deletion of your account, please follow the steps mentioned-above.
Please note that the deletion of your personal information from our database will result in us not being able to provide you with any services.
If applicable, any legal requirement on us to maintain certain records of your personal information shall prevail over any of your requests. We may require you to prove your identity before providing you with copies of your personal information.
10. Changes to our Privacy Policy
foodpanda reserves the right to alter all or any part of this Privacy Policy. Any changes thereto will be notified via the Website and, where appropriate, through e-mail notification.

Our Website may have links to other websites. This privacy policy only applies to the Website. You should therefore read the privacy policies of the other websites when you are using those sites.
12. Deletion of data
You are free to choose whether or not to provide relevant personal data and categories. Please understand, if you refuse to provide personal data, fail to provide correct personal data, or request foodpanda to delete some or all of your personal data after providing it, when the data is essential to providing services, foodpanda may not be able to perform necessary operations or provide related services to you.
